Terms of Service

These Terms govern your use of Mzansi Mind (“the app”, “we”, “us”). By using the app, you agree to them. If you do not agree, do not use the app.

1. Eligibility

Mzansi Mind is intended for people aged 12 or older. A person under 12 must not use the app. If you are under 18, or under the age at which you can independently agree to these Terms where you live, a parent or legal guardian must review and agree to these Terms and give prior permission for you to use features that send personal information online, including online AI, photo questions, sign-in, feedback and optional chat improvement. Available offline features can be used without sending prompts or photos to us while optional improvement sharing remains off. We do not ask for or store your date of birth.

2. Accounts

You can use available features without an account. Social sign-in uses Apple or Google through Firebase Authentication. You are responsible for your device and account security. Do not share access or impersonate another person. You may delete your account in Settings or through our web deletion page. Deleting an account does not cancel a store subscription.

You may optionally share or apply an invite code. A code is for invitation attribution only unless the app expressly states a separate offer and its conditions. You may not create fake accounts, use your own code, automate redemptions or misrepresent a code as guaranteeing money, Pro access or another reward.

3. The service and AI limitations

Mzansi Mind provides built-in offline tools and online AI assistance in supported African languages, including simple offline writing or reference help and, when connected, broader explanations, search-assisted answers and photo questions. Features vary by device, connectivity, language, plan and provider availability. We may maintain, change or discontinue a feature, but changes do not remove consumer rights that cannot lawfully be excluded.

4. Your instructions and content

You keep ownership of text and images you submit. You give us a limited, non-exclusive licence to transmit, resize and process them only as needed to operate the feature you requested, prevent abuse and handle feedback you explicitly submit. If you separately allow future text chats to be used for improvement, you also give us a limited licence to retain, review, redact, analyse and use those opted-in text questions and answers to improve Mzansi Mind. You can withdraw that permission for future chats and request deletion of retained source copies in Settings. Withdrawal cannot undo model improvements already completed. You confirm that you have the right to submit the content and that it does not violate law, privacy, confidentiality or intellectual-property rights. Online AI processing and retention are explained in our Privacy Policy.

5. Acceptable use

You may not use the app to:

• break the law, defraud, threaten, exploit, harass or harm another person;
• create or distribute child sexual abuse material or sexual content involving minors;
• facilitate violence, malware, credential theft, evasion of safeguards or other serious harm;
• infringe privacy, confidentiality or intellectual-property rights;
• scrape, resell, overload, reverse-engineer or bypass service, safety, age, usage or payment controls; or
• misrepresent AI output as verified professional advice.

We may limit or suspend access where reasonably necessary to protect people, the service or comply with law. You may contact cs@vakoop.co.za to challenge an access decision.

6. Free features and Pro subscriptions

The free service has usage limits. Mzansi Mind Pro provides the benefits and billing period shown on the purchase screen. Limits may exist to protect service availability and prevent abuse; Pro is not an unlimited service.

• Current plans may include weekly, monthly and yearly auto-renewing subscriptions. The exact local price, billing period, included benefits and any trial are displayed by Apple or Google before you confirm.
• Payment is charged to your App Store or Google Play account. We do not receive your full payment-card details.
• The subscription renews automatically for the displayed period unless you cancel before the store's renewal deadline. The store shows the renewal date and manages cancellation.
• You can manage or cancel in the app's subscription section or your Apple or Google subscription settings. Access normally continues until the paid period ends.
• You can restore an eligible purchase in the app. Pro access is associated with the store purchase and the Mzansi Mind identity used when it is linked.
• Price changes, refunds and billing disputes are handled under the applicable store rules and law. Nothing in these Terms limits rights you have under South Africa's Consumer Protection Act or another mandatory consumer law.

On Apple platforms, the Apple Standard End User License Agreement also applies to the app where required by Apple's platform rules.

7. Privacy and third-party services

Online AI requests are shared with Google Gemini only after the permission step described in the app. Optional retention of future text chats for Mzansi Mind improvement requires a second, separate choice and does not affect Free or Pro access. Sign-in, subscriptions, hosting and security also rely on providers identified in our Privacy Policy. Their service terms may also apply to their part of the service.

8. VaKoop affiliation

Mzansi Mind is built by VaKoop (Pty) Ltd and may suggest the affiliated VaKoop marketplace when relevant to a buying, selling or income question. We aim to disclose the affiliation and distinguish suggestions from neutral comparisons. We do not guarantee a listing, sale, buyer, seller, price, delivery or income outcome. VaKoop marketplace use is governed by its own terms.

9. Intellectual property

The app software, visual design, branding and our original content belong to VaKoop (Pty) Ltd or its licensors. We give you a limited, personal, revocable, non-transferable licence to use the app under these Terms. These Terms do not transfer ownership of your content or third-party content.

10. Availability, warranties and liability

The service is provided on an “as available” basis. We do not promise uninterrupted access or that every answer is accurate. To the maximum extent allowed by law, we are not liable for indirect or consequential loss caused by reliance on AI output or misuse of the app.

Nothing in these Terms excludes or restricts liability, warranties, remedies or consumer rights that cannot legally be excluded or restricted, including applicable rights under the Consumer Protection Act 68 of 2008. Any stated limitation must be read subject to that rule.

11. Ending use

You may stop using the app at any time. Account deletion is available as described above. We may terminate or restrict the service for a material breach, serious safety risk, non-payment or legal requirement. Sections that logically continue after termination, including payment records, ownership, dispute and lawful liability provisions, remain effective.

12. Governing law and disputes

South African law governs these Terms, without removing mandatory rights available to a consumer elsewhere. Contact cs@vakoop.co.za first so we can try to resolve the problem. You may also use any regulator, ombud or court process available under applicable law.

13. Changes

We may update these Terms when the service or law changes. We will update the effective date and give reasonable in-app notice of a material change. Where law requires fresh consent, continued use alone will not replace it.
